Used to be a toker myself when I was younger. Now I want to protect my lungs. Nothing goes in there but fresh air, if I can help it. I understand your frustration OP.
I know you said you like your window open but since it's bothering you the easy solution would be to close your window if it happens at a certain time. You said around midnight. If you don't like that idea (and I can understand why) then you can consider finding the source and explain yourself and see if they'd consider closing theirs.
If they are smoking outside well I guess that's a different matter.
Really depends on how far you want to take it.
