PS: Cost is so high because of the LED headlight (base LED is $3750, $5500 for laser) and also because of a driving sensor $4000 (only the size of a standard bifold)

I would escalate with the dealer and / or BMW NA ... they should be accommodating (you would hope).
Lemon route sounds like it will be a real challenge.
