I am reminded to inquire because I got the post-purchase call from BMW USA today, I asked how to bypass it, and she actually told me that you can put it in Sport mode and it turns this off. This is a big help because it's mostly stop and go traffic that makes it a pain in the neck, I can switch to Sport temporarily.
I used BimmerCode and set it to remember the last state (on or off). Super easy, works like a charm. I set it to 'off' and it just stays that way at restart.
