Do I need the dealer to update software?

I just got my CPO 2020 X5 x40i and noticed the software version is 07/2021.50

When I asked the dealer to update the software, they said "unless there is a problem, we wont update the software" and when I pressed them they said "if you insist we update the software, we will have to charge for it and you will have to sign a waiver that if anything goes wrong it wont be covered by warranty"

Are there any known issues I can point out that would compel them to update my software?

AFAIK there’s no universal issue that spans across different model years and variants. best bet would be an issue specific to your vehicle

So if the BMW dealer updates the BMW software the BMW warranty won’t cover anything that goes wrong?? That’s a crock of s..t!

Your dealer is incorrect as far as the warranty is concerned but they are correct in that most do not update for these of updating since BMWNA does not pay them for their time.

Dealer won't help

I have a 2023 X5 40e. I did a successful software upgrade earlier this year. But after I downloaded the latest update, the installation stopped and is stuck. The dealer told me they won't help without charging me $250 unless there is a problem. Over a month ago I asked a BMW genius and he told me BMW is aware of the problem, is working on a solution and try again in a few days. It's not just the charge for a car in its first year of warranty - they won't guarantee results. Not only is the installation stuck, I am stuck as well. Not sure what to do next.

Welcome to the forum. If there us another dealer nearby you can try them but you will likely get the same answer. After awhile the update will expire and with some luck you will get the next one and it will install.

Unfortunately it is best to take the approach that you will never get an OTA update that works so if you happen to do it will be a bonus. Is that the way we should have to view it? Definitely not but since the process is so broken it is the way to be the least aggravated.

My 2020 X5 40i had 2019 software on it for a very long time as I believe the previous owner never bothered to update it and the dealer didn't either.

It took me months and months of waiting to get offered any sort of update. When I did, I had to install them sequentially. If I recall correctly, I had a 2020 update, then immediately offered a 2021 update and then a 2022 update through the car.
