I've been holding off agreeing to purchase an X5 M60i thats at a local dealer. I've got multiple allocations offered up with early October delivery that I'm considering for a better deal than I'm getting locally.

I got a text from the GM of the local dealership tonight - "Parts are being shipped next week and priority is for sold units".

My understanding that this X5 on the lot will require parts and a software update to come off stop sale. Is that the correct assumption?

What’s up everyone I’m new to BMW previously had a Porsche Macan and new to the forum. Like a lot of other people in here my X5 is just sitting at the dealership. Personally mine has been there since August 8th so my first BMW experience has not been great to say the least.

Anyway yesterday I received a text from my SA advising they would be placing a new order for my X5 and that it should be here by the end of month (not holding my breath) and that they would either give me my original build if parts arrived first or the new build if that came in first. However, I told him I no longer wanted the original build which he was fine with. Also last week I told my SA that I was starting to get annoyed by this situation and considering canceling my build (tbh I wasn’t really considering it seeing how I already spent money on a body kit spacers and springs)

Anywho, they offered to take another $1000 off the vehicle. But yea, just wanted to share my experience for others who are waiting

*supposedly parts were suppose to be available for order 2 weeks ago. But just became available last week.

That is correct. Parts are being shipped and software is expected to be released by the 19th.

My build was submitted a couple days ago. My rep told me it won't be impacted by the stop sale but comments here make me wonder if that's the case. Can anyone offer clarity? TIA.

Not sure what comments you may be reading but new builds have been clear for coming up on a month.

I asked my UK dealer today if there were any updates on possible dates for the fix, this is what he emailed me back...

We have had some of the iX1's and X2's released from it so fingers crossed it will be sooner"

From what we've been told, the techs are already training on it, and at first, it'll take about 2 hours per car, but they expect the process to speed up as they "get used to" the update on multiple cars.

Welcome to the forum. Sounds like a dealer giving some sales talk so you can be very safe in ignoring that.

Lawyers I spoke with stated BMW and other manufacturer's are well aware that legally they are likely to prevail in a lawsuit brought by customers. My argument is/was I leased this vehicle in good faith. 1. BMW will NOT allow assumption/transfer of the lease (swapalease.com for example) with an open safety recall. 2. The vehicle now has substantial diminished value due to the uncertainty of the fix and/or when parts will be available and when car can be resold by a dealer (depends on your state), and 3. BMW refuses to buyback my vehicle with a substantial safety defect. Lemon law cant be applied because they refuse to take it into a service center because they recalled the part and there is no fix or parts available and 4. BMWFS does not allow 3rd party lease buyouts from other branded dealerships.
I got to the BMW corporate executive office level at Client Relations and they basically told me to pound sand. They couldn't give me an answer how they magically have a fix [and parts and/or software] for new 25's rolling off the assembly line in SC last +/-3 weeks and customers taking delivery without recall or stop sale. They issued and knew about this defect in at least February 2024. They leased me the car in June (May 31)- then recalled it in early August. They claim it's because they expanded the recall. They KNEW they had the IBS problem late 2023. So, on my now 13th new BMW and having purchased or leased well over $1M on new BMW product since the year 2000, they offered NOTHING. ZERO. NO GOODWILL LEASE PAYMENT. NO BUYBACK. Zilch. Their apology was even half-baked and sh!tty. So, lesson learned. I may just take the additional $5k hit and sell it anyhow. Keep in mind you can only sell a leased BMW to either a BMW dealer or a dealer that has a BMW dealership within their umbrella. Everyone has recalls - the way in which the manufacturer handles it and customers speaks volumes. Based on the lacking customer service, design language and direction BMW is going with the neue klass vehicles and infotainment, this will likely be my last BMW (esp after seeing what they did to the X3) . What I will replace my BMWs with, I don't know yet.

I was wondering if there was a way out. Best trade I got was 80k, 13k from msrp.

Unfortunately BMW is exploiting a loophole for a problem they are ultimately responsible for and knew about well before they leased the vehicle to me. 2 lawyers advised me I do have a case for fraud but the cost to litigate with BMW is not worth it. If its safe to drive as BMW claims, why issue a voluntary recall before you know how to fix? Why stop sale and then 3 weeks later start to manufacturer again not under recall or stop sale. Common sense and logic kick in at some point. If they would have allowed either the lease assumption or waived the 3rd party buyout option for my contract, that would've been fair in my opinion. But they refuse to do so and it is unacceptable. I have spoken to the highest levels u can go at both BMWNA and BMWFS. BMWFS provided far better treatment than BMWNA. They actually told me it was unfair and not right but only BMWNA can release the provisions on the contract. My BMWNA executive case manager tried to blame BMWFS and then I sent her a letter from BMWFS stating only BMWNA can make the change - caught my case manager in another lie.
