It is the price from the factory not the price the dealer is charging you. They can change that if they want to but I was saying you should remind them of the price protection because the dealer is not being charged more for the MY25 like they told you.

No, the dealer is correct concerning the price protection. The price protection is on the invoice, not the customer's price. Thankfully the overwhelming majority will pass that along, evidently this one doesn't want to.

If I'm understanding it all correctly, I only have price protection on the MSRP of the vehicle. However, my initial analysis shows a like-for-like MY25 is only a $250 price increase from my MY24 spec anyway. What I don't have price protection on is 1) the discount the dealer offered me off MSRP or 2) the incentives I was given in January. Without knowing the future incentives for whenever my current status 105 vehicle would be delivered, they want to charge me an extra $700-$1,000 above the deal we made in January since my spec is "optioned out heavily". Which I'm guessing is the dealer just reducing the discount they offered me off MSRP.

1 - Correct, you do not have price protection on what they charge you, they can reduce their discount.

2 - When you filled out the credit app, assuming you did, you received a no-harm lock on the rates as well as incentives (military excluded). The length of this lock would be at least 60 days, 90 on the West Coast. They did up that to 120 days nationwide during COVID but that may have expired.

Bottom line is the dealer can charge you what they want, of course you don't have to take the deal and can walk away. Make sure you go to the general manager before accepting the increase. While it would piss me off that they changed the deal, if I really wanted/needed the vehicle as soon as possible then I likely would just accept it as the amount is not much in the scheme of things. If I was not rushed I would start shopping around and find another dealer.

Just curious, are there regularly published item/package constraints posted anywhere? I'm used to the GM Order Guides that get weekly updates that include items unavailable to order or configuration changes to packages.

Production constraint notices are sent to dealers and most times filter down to us eventually.

Any advice how to get my "non-refundable" deposit back should I decide to go that route? I think my CA is jerking me around. He said the MSRP price protection is only on the base price of the vehicle not the MSRP of my specific build. I also have a feeling he's trying to reduce the dealer discount by saying I don't qualify for incentives anymore. The $750-$,1000 that I was quoted on being the difference between my MY24 and MY25 cost is now $2,000-$3,300 and it's because "things are out of our control"...

Incentives did change so without seeing the specifics I can't comment on those. As far as the price protection goes, he is wrong about that. The price protection is on the specific build of the vehicle. He can refer to the notice from BMWNA regarding that. Keep in mind though, technically the price protection is for the dealer and not the customer from my understanding of it. I think all of the dealers have passed it along to the customer from what we have seen. If he doesn't relent, you should have no issues getting your non-refundable deposit back because it is not the deal you agreed to or even the vehicle you ordered for that matter. If they refuse it should be an open and shut small claims case. Even though I generally don't like this route, if you put the deposit on a credit card you can protest it if you are still within the time limit.

We ended up asking for our deposit back. The out the door price on the MY25 ended up being $3,359 more than the MY24 we ordered with the deal we had in place in January.

They obviously have people waiting for them and willing to buy at a higher price. Sorry you had to go through that but some dealers just will do anything for an extra dollar no matter how unethical it is.

Good luck with your search. The good news is that with 50e allocation becoming more plentiful we are seeing the discounts starting to increase. Hopefully you end up with a better deal than you had before.
