No idea. Just a wild ass guess. I know for other engines you need air suspension to get the 3rd row so I was thinking that maybe air plus M diff occupies some of the same space the folded down 3rd row would.

I think very few ppl with 40i will choose 3rd row seat (I know there are few on this forum did, but that's minority), not to mention 50i and/or m50i. I remember previous Toyota RAV4 had offered 3rd row in one of the trim levels as well. But the point was to move to the bigger Highlander if you really want the 3rd row seat. In BMW case, get the X7 for the extra room

Also, it can't be the M Sport Differential in the M50i causing the issue. The 2019 X5 40i was configurable with ZOR (Off-road Package) and 4UB (3rd Row Seat). The Off-road Package included 2T4 (M Sport Differential). The only limitation was you couldn't order 2VH (Integral Active Steering) with ZOR and 4UB. 2VH is not required on the M50i either, so that cannot be the reason they're not offering the 3rd row. It's definitely appears to be a marketing decision and not a technical limitation as to why they don't allow you to order 4UB on the M50i.

Because the M50d is a diesel school run wagon dressing up as a performance car
Seriously though it’ll be a demand thing. The M50i is the M lite so likewise doesn’t have a spare tyre either. The vast majority of buyers buy the M50i for the blend of X5M performance and luxury not to lug a troop of kids so BMW probably don’t see it as a worthwhile option to offer. |

It's kinda weird how options are not permitted with the 3rd row option selected. For example, in Canada, you can't have any of the 22" wheels with the 3rd row option.
Honestly, if I were to spend the money on an M50i and needed a 3rd row, I would move into an X7. |
