Accident Repair Hell
So I bought my wife a brand new 19 G05 and only just 3 weeks after some guy decided it was a good idea to illegally cut into the HOV and hit our brand new suv. Thankfully they had insurance, but it's a very shady one at best. It took a month for us to even get it into the shop with my dealer. Now the dealer is telling me they cannot find a single part and thus cannot return our vehicle. It's some sort of fender bracket he said. He informed us that his system states it won't be in stock until NOVEMBER. I don't know what i can do right now, we are without a 2nd car and have to carpool everywhere. On top of all that my wife is pregnant in her third trimester and is quite uncomfortable in my M4. What can I do? Could this be classified as a lemon? It took 3 weeks to build AND deliver this car, so I cannot for the life of my understand why it would take 3 months to repair. Any ideas are appreciated.
Edit: Overall very happy with how safe the X5 is. The guys truck and another car both got totaled while this thing took it like a champ. 18K repair however

There isn't much you can actually do because they don't have a part to fix it. You could call BMW and ask them to help the dealer get the part but its a long shot. You might want to brush up on what lemon law is in your state, but I have never heard of one covering a repair due to accident. Might also call major junk yards around see if they have a wrecked one in their lot and can pull that part off. Does your insurance cover loaner?

Sorry about your accident. However another strange case of not being able to obtain a part for a G05. ( The guy with the drive belt nightmare comes to mind) How can this be? Part should be orderable & delivered in couple weeks tops even if it's a German made part.
In 2nd year of this model now - unacceptable. |

18k. Wow, a little higher than I expected. I guess that explains why my insurance premiums are so high. Thanks for posting the photo. I'm swapping my xline wheel arches for painted M sport ones and your photo shows some details I was wondering about.
My replacement arches took some time to arrive. 3 of them came in 1 month and the last one took ~2 months. Is this normal for BMW parts? I've only owned Toyotas in the past and the parts always arrived next day at the dealership. Last edited by robby818; 09-15-2019 at 05:42 PM.. |

1.) Why isn't insurance providing a rental car?
2.) Have you asked the dealer / service manager for a loaner car during this waiting period? 3.) If the dealer says no - I would escalate to BMW NA for them to provide a rental or loaner during this period. |

Forgot to mention, we chose to not get rental because we assumed it shouldn't take that long and we could get a "loss of use" check instead. On top of that, insurance will only cover 30 days, even when not at fault. I've asked them to provide a loaner and the dealer has stated they are not allowed to. I agree this doesn't sound like a lemon, but if they cannot repair it in under 30 days i was thinking maybe it fits under that part of the statute for Texas. I'll try contacting BMW NA to see if there is something they can do.
PS: Cost is so high because of the LED headlight (base LED is $3750, $5500 for laser) and also because of a driving sensor $4000 (only the size of a standard bifold)

This is an insurance issue. The other driver's insurance should be paying for a rental car. From what I can discern, you declined the rental, but it would seem to me that the circumstances have changed. You may need to consult an attorney.

guys, lemon law applies to manufacturer defects not accidents. it's not something you want to throw around because from experience lemon law is very tricky and hard even in the best cases.

Pathetic and Inexcusable that BMW cannot provide parts. Raise hell. Start writing letters to BMWNA. Send certified mail. If no assistance is offered call your local TV station that does consumer stories. Your insurance company needs to put pressure on the other driver's insurance company if police report documents their fault
