Since you are getting a loaner and this is the first time (assuming that) they are trying to fix it you probably will not qualify the Lemon Law in Texas but you can try. I would think your best course of action would be to contact BMWNA directly and see if you can get some satisfaction that way.

First BMW,
From the various posts I have read, the process seems to vary from person to person. My recommendation is to contact BMW NA first to get the ball rolling, then buckle in for a long process. Prepare to have your patience tested.

This isnt the first time..Last few times they rushes going through the car and testing things because they put me in a X1 or 3 Series...I have 2 kids and 6'2 I need more space..They finally got me into a new X5 Loaner at this point they can take there time but without any ETA thats where my issue comes in.

Is there a generic number to contact them or is there a contact that has been used that I can reach out to..I dont mind being Patient just dont want to wait forever

To engage BMW NA, I sent an email to CustomerRelations@bmwusa.com. I wanted a written communication for my records. A customer service advisor was immediately assigned to my case and I communicated with her multiple times while my request for a buy back was reviewed by the regional management team.

I live in NC where the lemon laws are more favorable to the consumer versus Texas. I've had a loaner since day 1 of my car being serviced but having a loaner doesn't toll the lemon law clock in NC.

What was the reason for your buyback? It depends on the state of purchase usually, I bought mine in Maryland but live in Texas

My instrument panel blacked out constantly on my drive home one evening. I took it to BMW the next day and it's been there now for 6 weeks. A new instrument panel was ordered from Germany but was damaged upon arrival. I requested a buy back at week 4 and it was granted in week 5. I've since learned that it's more accurate to say "trade assist" rather than buy back. I live and purchased vehicle in NC. Perhaps MD lemon laws might be more consumer friendly than TX.

Your situation is very clear and easy to see why a buyback would move quickly.

wow, I guess we got lucky. Bought the very first batch of X5 50i and drove it for 2 years and 22k miles. The only issue we had was the active grill and it was resolved fairly quickly. It was actually very reliable as we did multiple trips 600 miles plus with no issues after the active grill issue was resolved.

My buyback process was extremely easy. I thought it would be more difficult since I purchased it from a different dealer than the one who handled the repurchase. They asked me if I wanted the same options or wanted to add anything and they would give them to me at cost. At time of pickup they even gave me some free swag from the accessory department.
