The engineer in NJ would install a new software and then send them out for a 40 mile drive to test it. Apparently they did that 3-4 times.

Oh No. And here I was following your thread and was happy to hear the good news, and then got bad news again....
When the X5 is "working", it's a a fun drive. I hope they resolve the problem and get it back to you soon.

Oh I love it for the limited time I’ve had it. That’s what makes it so frustrating is I absolutely love the car.

The least they should do is waive the coming months payment assuming it's not paid in full, however they wouldn't offer it but you need to ask for it. It's totally unacceptable to get a brand new car not working few hours later and you've been too bloody calm about it

At this point I would just ask for a buyback and get a new one, assuming you would want another one. Unless you're willing to wait it out.

But again, start documenting everything. All communications (try to communicate by email, but take formal notes of any verbal conversations including who, when and what about), how long it has been in the shop/unavailable, etc. Better to have that information available and not need it, then need it and not have it. If BMW clams up (the dealership and/or corporate) get legal counsel.

They told me a buyback similar to lemon law is a long process and that we are no where close as of yet. I may call corporate and see what they say.

He is a long way aways from being able to pursue a Lemon Law case in Texas. There are a few different ways to become eligible for a Lemon Law case there: the four times test, safety hazard test or the 30 day test.

This wouldn't fall under the safety hazard and the 30 day does not apply since he is getting a loaner car. Probably could argue comparability but highly unlikely that would succeed. Given that, he would have to wait until they tried four times to fix the problem and have not been successful.

Well how many times have you taken it in so far? Twice? Two more times within the next two years and it will meet the criteria. For California, it’s just 30 days, regardless of loaner, and it doesn’t have to be consecutive.

Like I said, start documenting everything.

It doesn’t hurt to ask for a buyback or buyer assistance now, before you reach any legal threshold. If it takes a long time, so be it. How long has your car been in the shop? What are the chances it will return? The time necessary, assuming BMW agrees, may be less than the time your car is stuck in the shop while BMW engineers scratch their head.

I bought it on the 18th. I’ve had it 2 of the last 12 days since I purchased it.

Taken it in twice.

Today a week later there is still no update.

Thoughts and suggestions
talk to the GM of the dealership, request to have your first payment covered. BMW may cover it in certain situations, sounds like you may have a case.

Thanks for the advice. I talked to them today and they told me they will cover the first payment.

It’s still in the shop. They are bringing in another engineer to the team that’s working on it. They still don’t know what’s causing it.

thats awesome. Usually BMW will, if the car is in the shop for a certain amount of time. Def worth asking especially in your situation!! Well I hope you get is dialed in ASAP and you can enjoy the new ride, what a bummer! But im sure they will get it set up soon!

My buyback took less than a month for approval and then waited 45 days for my build. Took delivery of 1st X5 in June then took delivery of new one in August. The dealership and BMW were great to work with. I never once spoke to BMW, only dealer.

I had impeccable documentation, notes and emails.

Well hopefully I won’t have to go the buyback route. After 3 weeks I got my car back yesterday and so far so good. I hope it stays this way. I love the car!

Hi JJAviator, I picked up by 2021 X5 on 8/29 and yesterday, one week after delivery, the check engine light came on. I started it remotely and then noticed when I got to the car that it was off. When I started it again from inside the car, the check engine light was on. I drove it about 5 miles or so, parked it as I visited with family, and then when I restarted a few hours later, the light did not come on. So unnerving for a car that is so expensive and new. I plan to call the dealer to take it in on Tuesday, so they can check the code. Please do post if you need to take your car back in -- would be good to know. Thanks.
