Things got a little interesting. Got a call that and they will move forward with the exchange and get me a new 2019 X5 xDrive 50i M Sport (just like my current one). They've asked me to build one online since I wanted to add a couple more things to it (at my expense). But... now knowing that the 2020 BMW X5 M50i are a green light. I've asked if its okay to go with the 2020 model and pay the difference but they said I'll have to stick with a 2019 model for the "exchange program". Any advice would be much appreciated.

Wow, that is amazing. They must think there is more of a problem than just a few isolated bubbles. If they are offering to exchange then probably best to take them up on it. I can understand them not wanting to wait until next year to get into a different model. Did you ask them if they would just buy it back rather than exchange? Maybe they would go for that and you can just wait to order the M50i. May cost you a bit for a rental if you need a vehicle in the meantime but could be worth it to you if that is what you really want.

Yes, I did request for just the buy back so I'll wait it out till the 2020 X5 M50i if they are not willing to wait but that request was turned down.

Highly unlikely if it was just due to a paint issue. Lemon Law probably would not apply either since in Texas if a comparable loaner is given that usually negates the 'time without".

Scratches

When I went to my dealer to take delivery of my X5 M50d, lo and behold, I found quite a few scratches on the car. I refused to take delivery and the dealer had to first send the vehicle to a high end detailer that does Ferrari's/Porsche's etc. in Cape Town to correct. In the end it all out turned out to be fine. Cost them about R40'000 / $2'760 to correct.

Funny thing is the detailer told me a few weeks later that he suddenly received about 7 X5's coming in for the very same issue from different BMW dealerships in the region.

Not sure if this is a factory quality control issue or perhaps not enough wrapping around the vehicle before it is shipped. The vehicles from the Spartanburg factory first go to Bremerhaven and then shipped onto South Africa from there.

Somewhere along the line, something is amiss.

Had the same problem with with a X3 M40i that I purchased last year, also from the Spartanburg factory.....subsequently got rid of this vehicle.

"The 30 Day Test

If your new vehicle has been out of service for repair due to a defect(s) that substantially impairs the use or market value of the vehicle due to defects covered by the warranty for a total of 30 or more days during the first 24 months or 24,000 miles, and the problem still exists. If no comparable loaner vehicle was provided to you by the dealer during this time period, you pass the test."

I guess technically I had a rental they didn't have a loaner so I was given a rental but either way I suceeded

As I did. But in my case I was going to use the legal services as a last resort. Things seems like its working out and so far so good.

it shouldn't be a last resort because without using any legal means most places don't take you seriously and won't do anything from experience

In most case I would seek legal assistance, but in this case I was positive that I had more than enough evidence. It took couple attempts but I did manage to get it done.
As the 2020 X5 M50i is not in production at the moment I built and added couple more add on's for the 2019 X5 50i. Dealer confirmed the build and was told that it should be in by 4-6 weeks.

I did manage to take couple photos but I can not access the files.
In regards to the paint job... It was to the point that you can see the build up of paint running off the edge and the center areas had uneven layers.
