I’m wondering how receptive dealers will be to replacing the shifter cluster after a customer has a spill now with all this going on.

The spill looked like it was from the cup holders. And it was probably a decent amount, 3-5 ounces. They sent a video over showing what it looked like below. The SRS module is basically right underneath the cup holders and it clearly had coffee on it. So minor spills and condensation is probably okay. But there was absolutely no shroud or cover over any of the electronics below.

We invested in better coffee mugs since.

I guess I'll continue to be careful and watchful. I have towels and napkins in every door pocket just in case anything spills (I'm very anal about keeping my interior clean). I only drink anything on long trips. and rarely, I'll have a passenger who will bring a drink with them.

I've noticed the cupholder functions work well when the container has fully in contact with the cupholder. ie a coke can. I have aquafina plastic water bottles that have an hourglass shape and the liquid does not seem to stay as cold as a coke can does.

Anyway, its annoying that this is yet another thing I have to be watchful of but thanks for the update.

We previously had a '21 Audi SQ5 Sportback Prestige, and I think there was a class action lawsuit against them for something similar with the backseat. Something like someone's kid spilled a drink on the backseat, and it fried the engine control module underneath it. Audi wouldn't replace it under warranty. Believe a class action was filed and the guy won. We had a received notice of a recall for them to "protect" the module. Basically all they did was securely wrap a zip lock bag around the module.

I'll PM you also but I was wondering when you received your class notice. I have a 2020 X5 M50i that has been in and out of the dealership for this issue but we never received a class notice.

I got mine a few weeks after this thread was started. Looks like the settlement will be an extended warranty for the cup holders.

I also got a post card notice a few months ago about my 2020 X5 and X7. The master tech at my local BMw dealer said that if anything spills over and fries the airbag module the repair will not be covered by the warranty but this appears to vary by the dealer.

He is referring to the current situation. From what I read the would be covered as part of the settlement.

If I didn’t join the class action will I still be eligible or covered by the warranty extension? The reason I am asking is because I recently splashed some water I. The cup holders and low and behold passenger restraint system light popped on.

As per the website, no claims after 8-1-2023.
It only covered leaks inside the cupholders anyway.
What a joke.

Glad we didn't spill anything.
Anyone have a procedure to add spill protection underneath the whole area?
I assume there are drain holes in the bottom of the cupholders that can be caulked up but what about the rest.

I’m still not clear on a couple of points. (My fault I’m confident)

The damage occurs with seepage from within the cup holder itself, or exclusively from overspill (outside the cup holder)?

Has this been alleviated in 2023+ MYs?

It can be both places. The class action only covered the cupholder.
Seems to have expired, not clear about those with extended warranties.
2023 may have been fixed since they are not included.

From my experience heated and cooled cup-holders are one of the most unreliable accessories on any BMW, Mercedes, or similar. Don't get me wrong, I really like this convenience. However, you are lucky to get 2 years of use before they fail, even if you are careful and never spill coffee or water in the surrounding area. There is a separate fuse for the accessory but even if it does its job, it's probably too late to save the device from permanent failure. Collateral damage to the electronic circuity below the cup holders makes this even more frustrating. At least BMW has abandoned the old design of dash mounted pop out drink holders which would splash coffee all over the dash and air vents when you inevitably hit a pothole. Thinking back to older vehicles from the 70's you would never find a drink holder anywhere in the passenger compartment. Maybe we have gone too far with 4+ more drink holders in modern cars as it's just another accident waiting to happen.

Hi everyone - the settlement reimburses you if you paid for the repair and gives new warranty on the issue for 7 years or 75k miles (whichever occurs first). Originally there was no warranty coverage for this issue. There is a settlement claims administrator handling the reimbursements and the dealers are all now supposed to do the repair for free under the above terms. If you have more questions about the resolution let me know. I am the Class Counsel on this case. Thanks.

Saved $3,000+ because of the settlement

2020 BMW X5.

The gear shifter was frozen in the "P" position and would not move out of that position. We had to have the vehicle towed to our Boise BMW dealer. They sent us pictures of the gearbox electronics, a portion of which was corroded due to the "external influence" of liquid, and therefore the parts and repair would not be covered under warranty, and the estimate to repair was $3,000.

I called an independent mechanic for a second opinion. His advice was to go online and see if other owners encountered this problem -- bonus points if there's a class action lawsuit related to it. Because the dealers don't always know about emerging common problems. He said if I find something, take it back to the dealer and convince them to cover it under warranty. If that doesn't work, take it up with BMW North America.

God's providence led me to the class action settlement referenced in these posts, which was recorded only last month in September 2023. I asked the dealer to cover it under warranty, and attached a copy of the settlement. They would neither confirm nor deny the settlement applies, given it emphasizes an SRS light problem (even though it also includes any other problem caused by liquid flowing through the leaky cupholders into components under the center console).

That aside, they offered to do the repair, "at no charge to me" as a "one time goodwill gesture" to me as a customer. Additionally, they are looking into other problems that might be related to cupholder leaks - such as an overheating wireless charger, which could result in more than $3,000 in repairs.

It doesn't matter to me, but my guess is they will submit the repairs to BMW North America as a warrantable repair and not have $3,000+ hit their dealership profit.

Hope this story helps others that deal with the same or similar problems.
