Week 49 production

Well, I am cutting it very close. Ordered a loaded 45e on Oct. 29 and have a week 49 production. SA at a Chicago dealership seems pretty confident it will arrive by the end of the year. I had been planning on an iX I ordered in August (in time for the tax credit but no production number yet). In the end, I became concerned about winter driving range (and lack of Level 3 chargers outside of larger cities) and switched to the X5. Hoping I can still get in for the tax credit with the 45e instead.

Welcome to the forum. You should be able to get it in time for the year end.

As an aside, very, very few folks will be eligible for the tax credit using the Transition rule, what did you have that you considered to be a binding contract that would meet the requirements?

To clarify what TurtleBoy is asking, the BMW iX has final assembly in Germany and effective August 16, 2022, it no longer qualified for the tax credit unless you had a binding contract under the Transition rule.

Yep, no guarantee with the IRS, but I did have a binding contact (signed before the new law) under state law with no liquidated damages provision, etc.

Interesting, we have not seen any dealers that we’re giving a binding contract that would meet the requirements.

The standard forms the generally use aren’t binding so they would have needed to be changed for the IRA.

Just for clarity, you said in your original post that you switched to the X5. Did you really mean that? How did you get out the the binding contract? What clause in written contact allowed you to do that? If the contract had such a clause there likely would have been a hefty penalty attached to it (which may negate it being binding for IRA), was it really worth giving up. Of course if there was no clause like that how was it considered binding? Did you do a deposit? Of course that would make it non-binding also. Is your dealer just dropping things or will they be pursuing court action?

You may want to ask yourself if you can think of an example of any contract that cannot be modified or rescinded by mutual consent. Anyway, my post was about week 49 X5 production and that's the topic I'll be sticking to.

I’m well aware of the various options a contract can have. I was asking you about your situation since it is very unique. Not that it matters now but I think you were mistaken in believing you had a contract that met the requirements of the Transition rule. I could be wrong but given that we have not seen anyone else get one from a dealer that meets requirements that likely is not the case. If you don’t want to share details that is fine. Good luck with your build.

2023 BMW X5 45e  [0.00]
Hey folks, we were in 48 but a couple genius calls this week tell us we're now in 49. Both those calls however stated that week 49 was Nov 28 - Dec 2 (3?). But according to ISO week numbers, wk 49 starts Dec 5.

Anyone else been told the same thing?

No. I was told today that week 49 is Dec 5 and week 50 is Dec 12. I was told this because I have both a week 49 and a week 50 build.

You will learn that the Genius line is anything but. They are pretty accurate giving the week number since that is on the screen when they look up the build. Anything other than what is in front of them should be taken with a grain of salt as it if often, very often actually, incorrect.

I am week 49 and was just told I hit status 150 today!!!! Completion date between December 8th and December 11th. No stops or holds.

We also are in 150 as of this morning, F12 trick shows production date of Dec. 8.

We're inquiring as to the PCD program, as I really don't think it can get here to Los Angeles by Dec 31. I'd also assume though that there are limited or no slots left.

What was your most recent production week estimate? 12/12 is in week 50 I believe, so I'm wondering if your most recent estimate was accurate.

I'm curious because I have a week 50 production estimate, and I figured it wouldn't go to 150 status until sometime next week. Your car seems to have hit 150 fairly early.
