Sellers Beware!! Paypal Scam by DKUCHTA

I sold wheels on this site to member DKUCHTA. The sale was for wheels and tires that I shiped out of state from NY to MD for $700.00. The guy has the wheels for over a week and then E mails me that he wants a refund because 3 wheels are bent, and the car vibrates bad when driven, which is total bullshit. I was using the wheels on my car right up untill two days before I shipped them out. Also, cleaned the wheels before I sent them out, and would have noticed if they were bent badly. The only issues with the wheels was some curb rash which i showed in the pictures. My feeling is he did not like the way the wheels looked, or worse he bent the wheels himself in the week he had them. He enters a claim with Pay Pal saying the wheels were not as described, I send numerous pictures of the wheels (from my e90 post listing) to pay pal showing they were in good condition. Paypal reviews and sides with me. Then this Scumbag calls his credit card co. and is able to reverse charges. Of course the credit card co. takes his word being he is their customer.

So now, he has the wheels and did not have to pay for them. My Paypal is negative 700.00 + and have to take him to small claims court.

Basically, what I want everyone to know....If you sell something via Pay Pal, and the buyer uses a credit card to pay Paypal, you have no protection as a seller. Anyone can just "make up" that the mechandise was "not as described" and the card co. will reverse the charges to Paypal. Now if I dont Pay the money to Paypal, my good credit score will be in jepordy.

Yup, sucks balls. I have an online ecommerce business and basically anyone can file a charge back for whatever they want and we are sol most of the time. You also get a lot of people trying to use stolen cards which we would also be responsible for.

That's why when I sell my personal stuff I like to sell it to locals with cash.

That does suck.

But honestly you really need to pursue small claims court and get the money back. He sounds like a scandalous, irresponsible person and probably won't even show up to court, giving you the default judgment.

Just put that $700 back into your pay pal account and keep your hands off of it until he responds to your legal threats.

BTW - it is VERY easy to file in small claims. Just fill out a few forms and get the ball rolling...

Even if I got a defalt judgement, whats to say he'll even pay that. I just wish these wheels went to another member that would acually have enjoyed them. If this was'nt a scam the guy could have just re - sold them and got his money back. Funny how he has not posted at all since this happend. I should have known better than to sell to someone with 4 posts.

They were shipped packed up very well with the tires mounted, full of air. Highly unlikely the were bent during shipping.

He'll have to pay it or they'll ultimately garnish his wages.

These kinds of horror stories remind me why I hate paypal. Cash talks, bullshit walks.

1) You would have to sue him in his state and you would have to travel to his state to present your case in front of a jury or judge.
2) Most states will not allow garnishing wages for anything other than debt owed to the government or back child support.

I think you're pretty much SOL. The best you can hope for is splitting the shipping cost with him and have the wheels back and hope to sell it to someone else.

You should be able to sue him in either state as it involves interstate commerce and your state might have a long-arm statute that allows for you to sue him in your domicile state

On the few occasions I've had to sell things, I tend to ignore PM's from people with little or no site history. You probably exclude a few real buyers that way but I have a hard time understanding how someone could know enough about what I am selling to be real and not have ever contributed anything to the forums. I've had people post in a thread or PM me with a 1 post history. This guys got what, 4-5?

I always do an immediate transfer to my bank account when I get paid for something. Wait until it hits your bank account, then ship the item. That might take 3 days, but so what..you CYA.

That way, if they reverse or debit your PP account minus money...no biggie!!! WTF is PP going to do? Nothing they can do.

Let them close your PP account or make it negative.

You have proven to them the wheels are fine and PP sided with you...let PP and the CC company fight it out.

I think that's what he did. He did say that Paypal now claims he owes them $700 didn't he?
