Is it possible to request refunds on monthly payments due to being held in dealer?

Hi friends, I purchased my new 2024 X5 50e in October 2023, financing with BMW bank. It had a check engine light on issue in December. I sent it to the dealer for repair and they held my car there for 40 days because they needed to back order the combine charging unit from Germany. I picked up my car early February. Then in early March, my car reported a draintrain malfunction error and was towed to the dealer again for replacing the draintrain. It was held in dealer for 10 days. So in total, my car has been held for 50 days in the dealer for the first six months. But I still paid my monthly payment. Is it poosible for me to request refunds for the payments of these 650 days from BMW bank? Are there any examples for you guys? Thanks!

doesn’t hurt to ask.

when my 45e went in due to a recall on the HV battery module about 10 months after purchasing, BMW compensated $1000 up front. (they did this for everyone involved in the recall, though.) the service took about a month. had it taken longer, I would’ve fought for subsequent compensation

You can always ask but they did provide you a loaner is the what they will say.

Might be worth looking into the lemon laws in your state.

Lemon law are your friend and i would bring it up to your bmw. They don't refund your payments but they do reimburse you for your down time with the car depending on the situation. I've had this happen twice and BMW sent me a check for a few thousand dollars since my car was out of commission. Also if its out of service for the same reason for more than 30 days I got it replaced with a new car under NY rules.

My 50e went in for several check engine services in January this year and overall it lasted about 6 weeks. I was provided a loaner vehicle during the service time. I asked my service advisor if they could reimburse me for loan payments for the time I could not use my vehicle (also through BMW financial) and they agreed. They mailed me a check for 1 month's payment when I picked up the vehicle. I can't remember if it was a check from my dealer or BMWNA but I think it was from my dealer.

1) You still own the car
2) It makes no sense for the dealer to refund money that you paid to BMWFS for a problem they didn't cause
3) I'd be shocked if BMWFS did anything since it's not their car

Theoretically you might get a couple bucks back to go away but nobody will actually refund your monthly payment.
