That is exactly what the law states, and we are working with the Texas DMV lemon law department. At this point we are just hoping that BMW can admit that they are unable to fix our vehicle and do the right thing by buying it back. We are literally stuck between a rock and a hard place.

There is some nuance to that. If they are giving a loaner then you can't qualify for the Texas Lemon Law using the 30 day test. The vehicle can still qualify for the Lemon Law using the Four-Times and Serious Safety-Hazard tests.

Sorry you have to go through this. I'm sure you have but keep escalating the problem with BMWNA. You may also want to write to the CEO and the executive contacts.

I appreciate that information, and will try some communication with those contacts. But from my understanding since we are working with a state lemon law rep, BMW will no longer communicate with us (except for the service dept, who have been wonderful). Doesn’t hurt to try though.

Yes, usually one a Lemon Law case is started then they stop communicating. I would be honest with them and let them know you have started that process but you also would like to work things out with them. Good luck and let us know.

Our saga is finally finished. BMW came through today and we were able to get out of our X5 50e and purchase a 2024 X7. This was such a stressful situation and I’m glad that it’s over.
