Anyone ever have a dealer sell you a car that someone else ordered?

well, happened to me.
I've been waiting on this car for 2 weeks, placed a down payment, signed a contract. Then when tracking the vehicle, BMW Genius kept telling me it's not in my name and destined for another dealer. I brought it up - twice - and they kept saying the system hasn't updated.
Then today when I was supposed to go get it they called and said, "er, uhhhhhhhhh, we didn't know it was a production vehicle. It's been sold"

That sucks. I guess you can give them the benefit of the doubt and go with them being totally incompetent rather than trying to screw you over to make more from someone else. They should be giving you an outstanding discount on the one they are going to order to replace the one you didn't get.

yeah, except now they're trying to sell a much more expensive vehicle with fewer discounts. I'll probably complain to BMW Corporate on shady trade practices.

What idiots. Get your deposit back and I'm sure there are many other dealers that would like to treat you right. You may want to mention this experience to them and perhaps they will try and make up for it.

What does it say on the contract that you signed? Was the production number listed there?

Who is the dealer? Name and shame?

The VIN was listed of course. Now I'm trying to get back my deposit
BMW of Vista and Encinitas. They both were blaming each other for the fiasco.

Update - BMW Valencia helped me with understanding Invoice price and all the acceptable discounts, like Military, COSTCO, etc. They didn't hide anything.

BMW Encinitas is an Autonation dealer.

I've tried to buy a car there many times over the last decade. Could never make a deal.

I tried again a few weeks ago on an X5M50. The CA said they couldn't discount the car at all, and even said that they usually mark them up over sticker, so I actually was getting a good deal since the deal was at sticker. Uh ok.

Yes, same with me. They were complete jerks. I hope their business fails by us mentioning how poorly they conduct business. I will report this entire fiasco to BMW Corporate Relations next week. I doubt anything will be done because in the world of selling cars, dubious practices abound, and few get called out on it. I won't name personal names here but I got all the names written down it will go to corporate.

This is called bait-and-switch sales trick. A salesman at a Lexus dealer tried to use it on me on my last car. I walked out after arriving at the dealership and was told the car I came to purchase was no longer available.

Watch your special order like a hawk

We testdrove and agreed to buy an X5 only to be told after negotiating a price that the car was a special order already sold to someone else! The already sold X5 appeared on the dealer's website as if it were in stock and for sale. The good part is that the dealer honored the negotiated price on the special order we placed to replicate the one that was already sold.

Most of my cars that I have purchased were not special order but the few I have ordered and waited for delivery always seem to have these unknown miles on them. Last one had about 30 miles. I've always wondered how or who puts those miles on MY car and I paid for it. Scares me to even leave the darn thing on the dealers lot for a period of time as they show MY car as a demo

Did you get a production number for that specific vehicle and had it locked in with your dealer in some sort of writing? what contract did you sign?

if you had been assigned a production number, negotiated the price on that specific car, put a deposit (lock) and have it locked in with some sort of writing then I dont see how they could sell it to someone else? Doesn't make sense?

Hopefully the dealer makes it right for you and you end up dialing something in soon

They are not supposed to use custom ordered vehicles for test drives. That is a sign of a poor dealership if they do that.

Some cars are randomly selected from factory for further quality inspection and end up with some extra miles on it; I don't remember how many miles, but could be an explination.

At my PCD, my delivery specialist pointed out that any cars with double-digit miles had been randomly selected for an additional quality check. My car was one of them and had 11 miles.
