For those that
live in a SULEV state, any valve cover gasket or eccentric shaft issues are covered by the BMWNA SULEV warranty. I just wanted to share this info. You can go to a dealer and ask them to replace these parts under warranty. Hope it helps others.

funny just had both of mine done under warranty at 133k and just over 8 years old. Was surprised it went as smooth as it did.

It should be covered under BMW SULEV warranty, state absolutely matter, so does the mileage and year of the car. It is not unlimited.
And Also it isn't the best idea to come asking for us to replace it. Legitimately we cannot unless there is an issue. There is a decent list of things that would actually be covered but it is more vin/age/mileage/area specific to the car then just saying its covered under SULEV/California emissions warranty |

But its possible to have em fail without faults. Still a dealer would need a drive ability issue at be able to point at that |

Technically yes. They would have to smoke test the car or should to see if there is an air leak, they should be able to check out fuel trims and see compensation as well
Working on this same issue myself right now. Car runs rough and stalls with no CEL. |

I am relatively certain that SULEV means
that ALL related parts have to be operating optimally. If the VCG is leaking and the Eccetric Shaft Sensor area is leaking, there is most likely a vacuum leak and everything is not operating optimally. As a matter of fact, I believe that spark plugs also have to be replaced after 100,000 miles as they affect how the car runs, and hence emissions. If dealers are trying to argue their way out of this, they are most likely not honoring the warranty correctly. That is a good time to talk to BMWNA customer relations.
