1,000 Miles - Broken Down With No ETA on Fix
My XM is sitting at the dealer dead. Tomorrow will be 8 days.
Had a check engine light on 7/19, two days before my scheduled break in service. Dropped it off on the morning of 7/21. Maintenance was completed, but then I was told the bad news. DSCi module (brake booster) is bad and needs replacement. No ETA on the part. Was told something like 450+ on backorder, with BMWAG expecting in 120-150 sometime soon, with no ETA on additional units. Vehicle is unsafe to drive, as they tell me the brakes could come on and stay on at anytime, parked/stopped or even while driving. I looped in the corporate contact I had from when I had all the issues with my last M5C. She is working on it from her end, but I am not holding out much hope. Last I heard from my SA was Tuesday, and he didn't sound very hopeful this was going to be fixed/resolved anytime soon. What a mess.

Very disappointing indeed. It's a shame these cars are having these drastic issues so early on. I know first year production run vehicles usually have issues, but the fact that it's escalated to the point of having no estimate for when these parts are available is unacceptable. We aren't in 2020 anymore.
For me, it's gotten to the point where I don't even know if I'll be taking delivery anymore. The XM I've preordered has been sitting at the port for months now. Whether it's related to this same issue or not is unknown; but one thing that is known is my excitement and anticipation for the car dwindles everyday. Best of luck to you. I hope they at least have some sort of time table for you soon. I will probably revisit the idea of picking one of these cars up in a year or so. I'm sure BMW will have already made changes to the car receptive of the feedback it's received (and it seems majorly negative so far), whether it be functional or economical. |

Update....
Still not fixed. Tomorrow is 14 days. Corporate says the part should be available sometime in the next 2 - 4 weeks. No exact date, but better that the previous unknown ETA. They have offered a very generous $ amount (several months lease payment) if I wait out until it is fixed, as long as I sign some sort of waiver releasing them from accountability (probably because a lemon law claim in PA is 30 days). The dealer has been very helpful so far. Provided a loaner throughout. They are working on a substitution of collateral, which would provide a swap out of the car. The issue is finding one somewhat locally that is the same or something I would be open to moving into. I "guess" if they can't, then a car would be ordered? They are waiting on BMWNA approval of an "offer package" to move forward with a swap. Looking on cars.com, there isn't much locally that would be ok with me for a swap. Corporate made it seem that if I swapped out the car, then the cash offer is off the table. But in all fairness, I haven’t broached this subject. I feel like I have significant leverage here. PA lemon law is very specific about 30 days of non-usage in the first 12 months. From PA DMV's website "Also, if your car is at the dealership for any repairs for a cumulative total of thirty days during the first 12 months or 12,000 miles, you may demand a refund or replacement." If the car is a lemon the value goes in the toilet. Verbiage about lemon has to be displayed on the vehicle at point of sale and the eventual buyer has to sign a waiver accepting they know it was a lemon. Plus the 30 days is cumulative throughout the first year. I will be at a minimum of 30-60 days already. The wife is apprehensive in taking back a car that has been sitting for 1-2 months to be fixed. I am leaning towards asking for it to be swapped out with either a locally sourced car that is acceptable\comparable, or having a new one built, with some sort of cash payment for loss of use. So basically a combination of the corporate cash offer and a substitution of collateral swap. Additonally, slightly more leverage is that my father just ordered a X7 from my dealer. He is very willing to cancel the order, if I don't feel like I am made right on the XM.

I am just over the whole situation. Today is day 17.
My dealer is working on a swap out into a new one. Issue now is the availability of something in the color combo I like with 22's and B&W. Very very slim pickings. Even if I expand to a few different color combos, I havent been able to find anything. Add to that my CA says the plant is shut down making XM's for August and September, so nothing new is being added to the pipeline. Oh.. and add to the mess the Sales Manager says they can only get me a car that is "priority 5" at a dealer, whatever that means. Plus they say I can't swap into anything that is a dollar less than the MSRP of my XM, which is proving difficult since mine had the M puddle lights from the factory which added about $200 above just about every other MSRP with the Orange leather and B&W. With the factory shut down, and the availability of anything on the lots that I would swap into, I am leaning more and more into just waiting for the part or returning it as a lemon (30 days).

I just received my XM back after my transmission issue. BMW offered me a $3500 goodwill payment but I had to sign a waiver that basically gave away my NJ Lemon Law rights. I wasn't going to sign it and two lawyer friends said to stay away as well. The dealer said he's never had anyone not sign it. Maybe his other customers are more trusting or brain dead. Not sure.

the brake booster issue is impacting the x7 s as well (2023 and 2024 models it seems). that partly explains the huge wait for parts - many more models than just the XM are experiencing it. sucks though for sure.

if you check the X7 board there are several threads about the brake booster issue; I waited 5 1/2 weeks, but others I believe are on week 10; also sounds like some X5 models have this issue.

Closing this out.
MY XM was taken back by my dealer last week. They sourced a car locally from another dealer that was near an identical match. Once it was decided by everyone that the car was approaching lemon law and needed to be taken back, it was a very smooth process.

My new one was produced more recently. However, the part that was bad is common amongst several X models. So it was just bad luck that mine failed and the availability was constrained. Could have happened on an X7 or X5, for what it is worth. Wasn't a "XM" only issue.

Well... that didn't take long. My replacement XM has about 700 miles on it. Just threw a check engine light. No errors or check control messages on the screen.
It's going in for the break in service in a little over a week. So we will see what it is. Honestly, this is just tiring and pathetic at this point. Leaning towards this one being the families last BMW purchase.
